1. General Provisions
- These Terms of Service (hereinafter "Terms") define the rules for using the website available at kaminski.link (hereinafter "Website") and the services provided electronically by the Website operator.
- The Website operator and service provider is Konrad Kaminski, conducting business under the name Kaminski.link, with registered address at ul. P.O.W. 17/404, 97-200 Tomaszow Mazowiecki, Poland, Tax ID (NIP): PL7732503951 (hereinafter "Operator").
- These Terms are established in accordance with the Polish Act on Provision of Electronic Services of 18 July 2002 (Journal of Laws 2002, No. 144, item 1204, as amended).
- By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Website.
2. Definitions
- User — any natural person, legal entity, or organisational unit without legal personality who accesses or uses the Website.
- Services — electronically provided services offered via the Website, including: providing informational content about the Operator's business, enabling contact through the contact form, and presenting the portfolio.
- Contact Form — a form available on the Website that allows Users to send enquiries to the Operator.
- Content — all texts, graphics, images, and other materials published on the Website.
3. Types and Scope of Services
- The Operator provides the following services electronically, free of charge:
- making informational content available regarding the Operator's business activities, including web development, online store creation, SEO, and marketing services;
- providing a contact form for sending enquiries;
- presenting the portfolio of completed projects;
- publishing blog articles and educational content.
- The Website does not offer user accounts, e-commerce functionality, or paid services. Any paid engagements are subject to separate agreements concluded individually between the Operator and the client.
4. Conditions for Using the Services
- To use the Website, the User needs:
- a device with internet access (computer, tablet, or smartphone);
- a web browser supporting current web standards (e.g. Chrome, Firefox, Safari, Edge);
- JavaScript enabled;
- a valid email address (to use the contact form).
- Using the Website is free of charge. The User bears the costs of their internet connection as per their service provider's pricing.
5. Contact Form
- The contact form allows Users to send enquiries to the Operator by providing:
- name (required);
- email address (required);
- phone number (optional);
- message content (required).
- By submitting the contact form, the User confirms that the information provided is accurate and that they consent to the Operator processing the submitted data for the purpose of handling the enquiry.
- The legal basis for processing data submitted via the contact form is Article 6(1)(f) of GDPR (legitimate interest of the Operator — responding to enquiries). Detailed information is provided in the Privacy Policy.
- The Operator undertakes to respond to enquiries within 3 business days.
6. Intellectual Property
- All Content published on the Website, including but not limited to texts, graphics, logos, photographs, icons, and source code, is protected by copyright and belongs to the Operator or is used under valid licences.
- Users may not reproduce, distribute, modify, publicly display, or otherwise use the Content without the prior written consent of the Operator, except for personal, non-commercial use within the limits permitted by applicable law.
- The name "Kaminski.link" and the associated logo are the Operator's trade designations and may not be used without authorisation.
7. Liability
- The Operator makes every effort to ensure that the Content published on the Website is accurate, up-to-date, and complete. However, the Content is provided for informational purposes only and does not constitute professional, legal, or financial advice.
- The Operator shall not be held liable for:
- temporary unavailability of the Website due to maintenance, updates, or circumstances beyond the Operator's control (force majeure, hosting provider failures, cyberattacks);
- any damages resulting from the User's use of the Website in a manner inconsistent with these Terms or applicable law;
- the content of third-party websites linked from the Website;
- loss of data resulting from circumstances beyond the Operator's reasonable control.
- The liability limitations set out above apply to the fullest extent permitted by applicable law and do not exclude or limit any liability that cannot be excluded or limited under mandatory provisions of law.
8. User Obligations
- The User agrees to use the Website in accordance with applicable law, these Terms, and common decency.
- In particular, the User shall not:
- provide false or misleading personal data in the contact form;
- send unsolicited commercial communications (spam) through the contact form;
- take any actions that could disrupt the operation of the Website, including attempting to gain unauthorised access to the Website's systems;
- use automated tools (bots, scrapers) to collect Content from the Website without the Operator's written consent.
9. Personal Data Protection
- The controller of personal data collected via the Website is the Operator.
- Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Polish Act on Personal Data Protection of 10 May 2018.

10. Complaint Procedure
- Users may submit complaints regarding the functioning of the Website or the Services provided by the Operator.

- the User's name or identifier;
- a description of the issue;
- the expected resolution.
- The Operator will review and respond to the complaint within 14 calendar days of receipt. If additional time is needed, the Operator will notify the User of the reason for the delay and the expected response date.
11. Amendments to the Terms
- The Operator reserves the right to amend these Terms at any time for important reasons, including:
- changes in applicable law affecting the provision of electronic services;
- changes to the scope or nature of the Services;
- technical or organisational changes to the Website.
- Any amendments to these Terms shall take effect upon publication on the Website. The date of the latest update is indicated at the top of this document.
- Continued use of the Website after the publication of amended Terms constitutes acceptance of the changes.
12. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Republic of Poland.
- For consumers residing in the European Union, these Terms do not deprive them of the protection afforded by mandatory provisions of the consumer's country of habitual residence.
- Any disputes arising in connection with the use of the Website shall be resolved amicably where possible. In the event that an amicable resolution is not reached, the dispute shall be submitted to the competent court in accordance with applicable law.
